A Toronto police officer was found guilty of using excessive force during the arrest of a G20 protester on June 26, 2010. Justice Louise Botham said “a police officer is not entitled to use unlimited force to affect an arrest.”
Constable Babak Andalib-Goortani had pleaded not guilty to the assault charge saying protester Adam Nobody had been resisting arrest. Botham says the explanation is nothing more than an after the fact attempt to justify hitting Nobody with a baton.
When Andalib-Goortani hit him, the protester had already been wrestled to the ground and there were several police officers piled on top of him.
Andalib-Goortani will be sentenced in November.
In a separate civil case, Nobody and his family are suing police for $14.2 million.
