A porn film mocking a Montreal police officer cannot be banned ruled Justice Helene Le Bel of the Quebec Superior Court on Monday. Nor can the makers of the film be obliged to pay $100,000 in damages, reports the Globe and Mail.
Constable Stefanie Trudeau has been dogged by allegations of police brutality after the release of two videos showing her in action. She has become known as Badge No. 729.
Trudeau objected to a porn film being called 728 Agente XXX. The film did not use images of her or use her name, but she argued the number linked the film to her.
“In the public sphere, freedom of expression authorizes and allows people to criticize, commend, debate and challenge, through procedures, protests, humour, caricature or parody, the actions of those who govern or those who, like police officers, are in positions of authority,” noted the judge.
Freedom of expression is constitutionally guaranteed by the Canadian Charter of Rights and Freedoms.
Trudeau is suspended from the force pending an investigation of performance as a police officer.
